PRIVACY AND COOKIE STATEMENT – BERG TOYS B.V.
In this Privacy Statement, we explain how we handle your personal data and how you can exercise your rights in relation to it.
By “we”, “us” or “our” we mean: BERG Toys B.V., having its registered office at Stevinlaan 2, 6716 WB Ede, the Netherlands. We are a data controller within the meaning of data protection legislation. This means that we are responsible for compliance with data protection legislation insofar as it concerns your personal data.
Collecting and using personal data of (potential) customers, including children
We would like to inform you that we will collect and use the personal data you provide to us, because this may be necessary, for example, to enter into and perform a contract with you, or on the basis of consent you have given us, such as for the #myberg content campaign.
If you are a (potential) customer, we use your data in order to send you a quotation, determine which specifications or requirements apply to a particular matter, deliver goods or perform services for you, invoice you, and communicate with you quickly and efficiently about the performance of the contract. For your order, we need your name, address, email address, payment details and telephone number. This enables us to process and deliver your order. The legal basis is that this processing is necessary to perform the contract with you.
Finally, we retain your personal data because we are legally required to do so under tax legislation.
You are not obliged to provide us with your personal data. However, if you provide no or insufficient personal data, it may be possible that we cannot carry out the activities referred to above.
Direct marketing
If you have given us consent, we will store and use the personal data you have provided to personally inform you in the future (via newsletters) about our existing and new products and, where applicable, make you an offer. Each time we send you a newsletter, you can let us know if you no longer wish to receive it. Please use the unsubscribe link at the bottom of each newsletter.
Disclosure to third parties
If necessary to process your order, we share your data with third parties, for example carriers and IT service providers. We agree with our partners that they will handle your data with the same care as BERG. We also use external server environments for storing (parts of) our sales administration, which includes your personal data. For that reason, your personal data may be provided to server hosting providers. Finally, we may be required to provide personal data if the law so requires or in order to comply with an order from a competent authority.
Our employees and third parties engaged by us are obliged to respect the confidentiality of your data. Personal data is therefore safe with BERG.
Where and for how long do we store your personal data?
If you requested a quotation from us but did not become a customer, we will delete your data no later than one year after our last contact. If you did become a customer, we will retain your personal data for a period of seven years after the end of the financial year in which the contract has been fully performed. The period of seven years corresponds to the period during which we are required to retain our administration for the Tax and Customs Administration. After this period, we will delete your personal data.
The data we hold, including personal data, is stored locally within the European Union, with the exception of data processed by third parties for analytics purposes, including Google Analytics. We use hashed first-party user data from the purchase stage and transmit it to Google in a privacy-safe manner. For this purpose, we use a secure one-way hashing algorithm to improve conversion measurement. Google protects and secures the confidentiality of this data.
Cookies
Cookies are small files that are placed on your computer, tablet or smartphone during visits to our websites. Information is stored and is recognised again during a subsequent visit to the websites. The websites use tracking cookies if you have given consent. We do this to gain insight into your online behaviour so that we can make you suitable offers. You can withdraw your consent at any time. Your data is stored for a maximum of one year.
We also place functional cookies. We do this to make using the websites easier. This includes, among other things, keeping purchased products in your shopping basket or remembering your login details during your visit. Analytical cookies show us which pages have been visited and which parts of the websites receive clicks.
Finally, we would like to point out that you can visit the websites without leaving personal data, unless you enter your personal details in our contact form.

Google Analytics
Cookies are placed to gain better insight into customer behaviour in order to improve the user experience of the website.
We have:
- entered into a data processing agreement with Google;
- masked the last octet of the IP address;
- disabled data sharing;
- not used other Google services in combination with the Google Analytics cookies.
Microsoft Clarity
We work with Microsoft Clarity and Microsoft Advertising to analyse how visitors use our website via behavioural statistics, heatmaps and session recordings. This data is collected using first- and third-party cookies and other tracking technologies. We use this information to improve our products and services, prevent fraud, enhance security and display targeted advertisements.
VWO (A/B testing and CRO)
VWO places cookies to perform A/B tests and optimisations. This allows us to measure which variant performs best and improve the website.
Tweakwise (site search and merchandising)
These cookies help us analyse and improve the use and performance of the search function and product display.

Flowbox places cookies to measure interactions with user-generated content (such as views and clicks).
#myberg terms
We are very proud of the photos and videos we come across online featuring our products, and we would love to share them on one of our (online) channels. When we see a post or message, we may ask you to share your photos and/or videos with us (hereinafter: content). This sharing will mainly take place on our website and social media channels, but it may also be shared on other BERG channels, such as our digital newsletter or in our email. We want to inspire others with your #myberg content!
By replying #yesberg to content on which we have placed a comment, you give permission for us to use your content for:
- BERG’s social media channels;
- BERG’s website;
- BERG’s newsletter or BERG email marketing;
- advertisements;
- social walls and/or digital screens in dealers’ stores.
In addition, you declare that:
- you own all rights to the posted content and have permission from all persons shown for publication. If the persons shown are minors, you declare that you have permission from their parents;
- you grant BERG an unrestricted, worldwide, non-exclusive licence to disclose and reproduce the content via our services or third-party services for commercial purposes. You do not impose any restrictions or limitations in this respect;
- BERG, or third parties on BERG’s behalf, may use your work to create derivative works. With regard to such derivative works, you have no right to inspect or approve the work, the advertising text associated with it or the purpose for which it is used;
- you waive your moral rights (or, insofar as this is not possible, you will not rely on them) and any claims to royalties in relation to your content or derivative works thereof;
- the use of the content by BERG does not infringe third-party rights, is not unlawful towards third parties and does not violate the law;
- by replying #yesberg, you give permission for BERG, or third parties engaged by BERG, to process your personal data (in some cases your username and captions accompanying your content).
If you do not agree to these terms and do not reply #yesberg, we will not use your content. No further action is required.
Attribution (name credit)
We will make every effort to always provide name credit. Is name credit unexpectedly missing from your content? Please let us know by sending a message via Instagram: @berg_global or by emailing us at [email protected]. Please indicate where you found the content, include a link, and tell us your name or username.
Withdrawing consent
You can withdraw your consent at any time. Would you like your content removed from a specific page? Please let us know by sending a message via Instagram @berg_global or by emailing [email protected]. Describe where your content is used (preferably with a direct link); we will remove your photo as soon as possible. Has your content been placed on offline marketing materials? Then we will change this at the next print run.
The terms and privacy/cookie statements of the relevant social media platform apply to the use of social media such as Instagram, Facebook, LinkedIn, TikTok, Pinterest, Twitter or YouTube, not our terms and privacy statement. Your rights
You have the right to ask us for access to your personal data. If there is reason to do so, you may also ask us to supplement your personal data or to correct inaccuracies. In addition, you have the right to request deletion of your personal data or restriction of the use of your personal data. After deletion of your account, BERG Toys B.V. will retain your content and personal data for 30 days; after that they will be deleted without the possibility of reversal.
You may also object to the collection and use of your data. You also have the option of lodging a complaint with a supervisory authority. You may choose to lodge your complaint with the Dutch supervisory authority, the Autoriteit Persoonsgegevens (the lead supervisory authority), or with the supervisory authority of the Member State in which you reside / are established.
